Agents' CMP kitemark scheme makes headway

The National Approved Letting Scheme has become the first organisation to welcome the SAFE kitemark inititiative spearheaded by a group of agents.

Under SAFE, agents who have client money protection in place will be able to display the kitemark. Subscriptions are a nominal £10 for promotional purposes.
 
Caroline Pickering, NALS chair, said: “Those agents who meet the criteria of organisations such as NALS, ARLA and RICS have to pay for compliance.
 
“It makes complete sense that they should get the added value for money that this single distinctive kitemark will give. Consumers should make their decision on who to place their business with based on the protection that they get, should anything go wrong.

“This kitemark will help to point them in the right direction, and as a consumer focused organisation we are delighted to have been asked to help the agents get this off the ground. We believe this is a very positive move for the sector.”

Letting agents have become increasingly concerned that agents who do have CMP in place through NALS, ARLA, NAEA and RICS are – in the public’s eyes – indistinguishable from agents who do not.

Yet in one recent case, an agent which recently closed down led to 120 people losing a total of £450,000.

One concerned agent who had to deal with the fall-out of a firm which had used its client account to fund its business through the recession, found that its landlords had believed they were dealing with a professional organisation because it showed the OFT and Ombudsman logos.

When a landlord complained to the TPO, they found out it was too late. The OFT advised that they did not deal with individual complaints and suggested the landlord contact the TDS, which in turn advised that as membership had lapsed, they should refer the matter to Trading Standards, which suggested that the TDS should deal with it as it was a deposit issue.

When the agent asked the landlord why they had used the firm, the answer was: “Because they were cheaper.”

Another concern for agents is that although all companies report to Companies House, a number do so showing negative balance sheets but carrying the caveat that the shareholders will support the company in the coming financial year.

Yet such agents are actually trading insolvently. Nor do their abbreviated accounts show any debtors, and crucially, nor do they include any reports for their client accounts.

Dave what is with all this register@safe stuff. I contacted NALS today and all that is available so far is press releases according to them there is no mechanism yet to join.

JS £285 would be a snip if you can join NALS for under £600 first year new member when you add in all the on costs beyond just membership fee and cmp (new member joining fee and accountant audit compliance charges, for example), you are doing very well.

We aren't members of any organisation. We are perfectly solvent - always pay rents on time, have have a ringfenced clients account. Why should some group of self proclaimed elitest agents suggest we are a risk to our clients? Are they on commission from NALS and NFoPP selling insurance?

Good idea - shows Lettings Agents in a good light - hope it catches on. Surprised to see Foxtons at the forefront - but hey - respect for that. Cynically, it tells me that not being a member could be bad for business!!

There are a couple of 'wide-boys' near us who are seriously annoyed at this - quote - "Who are these bloody agents - what's it got to do with them?"

They were the same people who said ARLA was a waste of money 'cos no-one cares. They may do now!

It was worth sending them the link after all!!

Good concept - but it will only work if the customers are properly informed. It could spell the end for uninsured agents - lets hope so. I am fed up with them undercutting

I like it - a lot. I thought it was going to be yet another cost to bear - its seems I was wrong. For once, an honourable concept. Fair play to those involved - glad I renewed my ARLA membership now!

I cant think of one single objection - provided there is consumer education and proper exposure - its a super idea. NFoPP wont comment - they will think their brand is enough because they assume the landlord / tenant will know their membership criteria. Then there are the others all who think their 'club' is best. Trouble is, dodgy agents wont ever tell customers thay aren't insured - when asked, they will say "We are member of the Ombudsman" which as we all know doesn't help when a business goes bust.

Its brilliant really - but will really upset those who aren't members of some scheme. I had no idea that clients accounts weren't sent to companies house! Unbelievable.

A great bit of consumer protection and a GREAT advert for the industry - well done to the Group!!

There really isn't anything much to say. NFoPP is following its usual course of sitting on the fence?
It ould be nice if they did say something. However, NAEA and ARLA, like others, are suppliers of money protection schemes and this is a new advertising 'kitemark' to show that you have it in place.

I think this is a great idea, but I'm puzzled why ARLA, NAEA haven't said anything about it yet. Won't the kitemark help publicise their own schemes? I'm told it's cheaper to get CMP through NALS. Can anyone confirm?

I hope someone from the Committee or NALS reads this because there is alreadty a very major SAFE kitemark for SAFE contractor
