A lettings sector trade body has written to a council accusing it of initiating an “unlawful” fee structure for a licensing scheme.
The Residential Landlords Association has written to Blackburn with Darwen council saying that as part of the local authority’s current selective licensing scheme, a licence holder pays a fee of £750 per property, with an annual fee of £150 for that property.
The RLA considers it unlawful for a council to charge an applications fee followed by an annual fee.
In its letter to the council, saying that by law a licensing scheme that does not permit a charge which amounts to an annual subscription.
The association is now calling for an urgent review of the licensing scheme.
The letter includes statements: “While we appreciate the serious funding challenges faced by local authorities this does not justify the charging of fees that are not lawfully permitted … The RLA requests that the council amends its current fee structure, splitting the licence fee into two parts and removing the requirement of paying an annual fee and remove the licence condition.”
