Eviction ban set to be extended in Scotland - will rest of UK follow?

The ban on evictions in the private rented sector looks almost certain to be extended until March next year in Scotland - with the big question now being whether the rest of the UK will follow suit.

First Minister Nicola Sturgeon has told the Scottish Parliament that she would like the extension to be enacted to stop what she describes as a possible “avalanche” of evictions because of Coronavirus-related arrears.

A formal consultation is still ongoing north of the border, and the parliament itself has yet to vote on the issue.

However, Sturgeon has told a Green Party member of the Scottish Parliament: “The [Scottish] government wants to extend that until March 2021. I can’t say that is definitely happening because it is up to this parliament to vote on that but if my party and his party vote for it then there should be no block on that.”

Unsurprisingly the campaigning charity Shelter - which has been at the forefront of a fierce campaign for an extension - has welcomed the possibility. 

Its Scottish division took to Twitter to claim it as their success: “This helps thousands hit hard by the pandemic to keep a roof over their heads. This is a big win for our supporters and us.”

The Westminster government has been strident in its insistence that the ban on evictions in England and Wales will end on August 23 - under two weeks time - and has made provisions for amendments to court procedures to ensure the cases are dealt with fairly.

The Westminster government has also given the go-ahead for the operation of so-called Nightingale Court buildings - additional courts in converted premises - to accommodate the backlog of cases that have built up.

    Just when we all thought landlord bashing couldn’t get any worse.. then came along COVID with the opportunity to make landlords cover the cost of housing defaulting tenants

    Government need to loan the money to the tenants and make sure they are paid to landloard
    Otherwise landlords will default. On mortgage and repossession will take place
    As seen by furlong companies are closing you will see more homeless and we still have effects of Brexit to follow
    Economic meltdown will follow
    And the politician are setting expectations that it is ok to break law this will then spread to other sectors . Eg people Not following Covid rules.

    Wales have, albeit belatedly, recognised this and ARE Lending TENANTS the rent money, Paid Direct to the Letting Agent or Landlord.
    The tight-arsed Scot Sturgeon should have followed Wales' example, instead of deferring the Scottish Govt' welfare responsibilities onto Private landlords, many will be single-property owners and employed as key-workers.
    Absolutely no thought, balance or fairness, as usual from Governments.

    The NRLA have disproved Shelter’s claim of a tsunami of evictions. Let’s hope they refute Wee Burnie’s false claim of an avalanche.

    Is it not about time we stopped calling them evictions and referred to repossessions instead? If you fail to pay your mortgage nobody says the lender evicts you, they repossess the property. Bailiffs evict, landlords repossess.

    pushing any repossession work back is simply delaying the inevitable. The claims i have advised on and are currently waiting are not all COVID 19 related arrears, many span back before the crisis and many landlord, suffering through no fault of their own, simply need to sell the property - how is that fair on them making them wait further.

    It is a typical Government response of using a sledgehammer to crack a nut. What will happen if landlords default on mortgage payments and the lenders seek repossession? Will the lenders then face the ire of Polly, GR, CA etc?

    BTL mum and pop operators, exit via the gift shop. Bold move in Scotland, and will be interesting to see what happens south of the boarder.

    Similar problems for commercial landlords so the non payment of rent needs to taken in context. Is there a lobby for government to pay shop rents too?

    You misunderstand commercial operations know they be forced to stop trading.

    LL should always be able to trade.
    But they are stuck with customers who refuse leave!!

    If tenants can't afford to trade then they should vacate.
    That then gives the opportunity for a LL to trade by sourcing a new rent paying tenant.

    Of course no LL can ever expect there will replacement tenants.
    But LL should be able to try and source new tenants but Govt prevents this occurring.

    In your world you would see nothing wrong in every BTL LL being repossessed!

    Eventually millions of homeless tenants.
    Or as would be most likely lenders would not sell into a distressed market they would become LL of last resort and then sell into the market years later.

    That is what happened in the 90's.

    Of course it would be a great way for Govt to continue with their eradication of small LL policy.

    Allowing LL to be repossessed because Govt won't allow them to trade will be socially divisive.

    There is no social housing that was available in the 90's to cope with all the repossessions.
    The social effects of such would be enormous.

    Not sure Govt really wants mass homelessness on it's plate
