The Directors have committed fraud by abuse of position here. The investigation will hopefully lead to their arrest, conviction and seizure of their personal assets to compensate the victims of their crimes.

I don't think it's daft at all for landlords to be compelled to be a member of a redress scheme, even if their agent does belong to one. The agent doesn't control the landlords purse strings does he? What if tenant reports a problem to agent and landlord refuses to pay to have it fixed?

What planet is that guy on? With the raft of additional tax reforms hitting landlords pockets they are going to be selling up or cutting costs. Agents who have become reliant on charging a months rent to find a tenant, double digit management fees and fleecing tenants will soon be a thing of the past. In fact, I'd go so far as to say that any letting agency which cannot survive on total fees of less than 85 of gross rents collected is going to find things very tough indeed. It's time for agents to cut costs, streamline their businesses through automation or face oblivion.

I agree that non-compliance shouldn't be tolerated, but I also believe in justice and a £20,000 fine just doesn't make sense for a crime of this nature. Compare that to a fine for speeding for example, both of which have similar risks to human life.

Councils who introduce Selective Licensing spend most of the funds they collect processing the payments. What little they have left they use to prosecute unlicensed landlords. All they are achieving is 'jobs for the boys' and misery for landlords and tenants who shoulder the costs of the inefficiencies of the Councils.

Police and CPS can be bypassed. http://privateprosecutions.org/ fund private prosecutions for groups of 15 or more victims of the same Fraud By Abuse Of Position.

Property118 Action Group Fighting Crime There are many examples of landlords having been victims of fraud by abuse of position committed by their letting agent where Police and CPS have dropped cases due to lack of resource. We have several cases ongoing where agents have used client money to pay themselves huge bonuses before putting their businesses into administration. As a result of the Police failing to get involved Property118 Action Group has been helping to raise the funding necessary to mount private criminal prosecutions on behalf of our members. Many of these are now coming to trial. Property118 Action Group pay all initial costs associated with private criminal prosecutions where groups of 15 or more of our members have been victims of crimes perpetrated by the same business. The Crown picks up legal costs once Magistrates agree that a trial is in the interests of the public, regardless of whether the accused is found innocent or guilty.
