Video gives fascinating insight into legal case against Foxtons

A fascinating insight into claims being made against Foxtons by a legal firm acting on behalf of landlords has been posted online.

In the video Chris Haan, of the legal firm Leigh Day - leading a group action against Foxtons - states there are several duties which a letting agent should discharge to landlords who instruct it to act on their behalf.

On the Landlord Law Blog, Haan suggests some of these may have been breached by Foxtons.

The first is that the agency should use a panel of contractors; Haan alleges Foxtons did not disclose to its landlords that it took commission from some of the contractors on its panel.

The second is that some contractors allegedly charged above market rates, which had the effect of boosting commission to Foxtons.

The third is that Foxtons is taking - in Haan’s words - a “bunch of fees” from tenants for some of its services, without revealing this to landlord clients.

It’s a fascinating summary of the case so far. It’s unusual to see a summary of this kind of a case still underway, and is well worth a visit online. You can find it here.
