I think the courts have already ensured there wont be any evictions over the Christmas Period. They are slower than an arthritic glacier. Annoyed Landlord is quite correct they aren't evictions in the main, in fact only 6% of tenants are actually 'evicted' by this means. In fact, people forget, when a tenant says they don't want to renew, its best practice to serve s21.

In fairness, it's not really a U-turn and rather a delay as industry had universally said due to the court process, the RRB was unworkable. The shock headline should be 'Government listened'.

People forget, we have a duty of care to our client to advise of current market rent. I know of one agent who has a claim against them for not increasing rent or advising the landlord of what the current market rent is. It's not a decision for the agent - we are paid to provide advice.

I welcome training even at what is an early stage. The RRB is a Trojan horse and very incomplete with many issues stating that the 'secretary of state may introduce regulations to XYZ'. As such the Bill will evolve through amendments & statutory instruments but it's important to understand what exists now and the implications. I agree that there is a possibility it wont happen under the Tory government however, Labour will pick up the reigns. That said, I have met with senior members of government who assured me and others it will happen as they need this in place before they start canvassing on the doorsteps.

PS: I would also argue advertising a property as 'unsuitable for children' where it genuinely is would be acceptable and could form part of material information

A landlord would be very unwise to provide a reason which is discriminatory. However, the reality is when they have multiple potential tenants queuing up, a landlord will simply select the one which meets their criteria. A flawed policy impossible to enforce designed to gain votes not homes.

I don't feel it will be problem many envisage. Best to see the detail before a knee jerk reaction. When similar was rolled out in Scotland, it was fine. It was only when the SNP went full tonto that problems were experienced - ie rent controls, removal of mandatory grounds etc.

This is a good thing. There is such a shortage of property in tourist areas where students have been shut out. Bear in mind also the effect of the proposed Renters Reform Bill which will effectively abolish fixed term tenancies, so landlords who make money with short lets during summer months will have no certainty of possession. It needs regulating,

Agents have a legal duty of care to provide advice. I have one office with a complaint to TPOS simply because the landlord wasn’t advised of the current market rent and wants compensation. We are not moral gatekeepers - we are agents for our clients.

An agent has a duty of care to the landlord to review rents. It is the landlords decision whether to do so. We have experienced one landlord claiming compensation as he believes we under rented the property, and another asked what the current market rent was and promptly dis-instructed us when we told him is was £150 more.

Pets policy is hardly new. All it says is that you cant unreasonably withhold consent, and this is not changing just being reinforced. Likewise, all forms of discrimination have been unlawful for years.

An agent has a duty of care to give landlords best advice. It is not our decision to act as the moral police. An agent who fails to give their client best advice, such as current market rent, is open to a claim of negligence.

Volunteer: a person who freely offers to take part in an enterprise or undertake a task. As opposed to chosen by oneself to act in a certain capacity or to fulfil a certain function, especially pompously or self-righteously: I don't understand your criticism. TLIC is trying to help landlords & tenants and steer Government in the right direction to the benefit of all. Why knock it? Where's the benefit to the members?

TLIC comprises almost every major agent, deposit schemes, landlord groups, professional bodies etc. It's hardly a 'collection' of rental experts. The last page of the report details some of these who gave up their time to consider these issues. Rather than self appointed, they volunteer to help improve the PRS for tenants & landlords. A full list of members can be found on the Letting Industry Council website

I suspect any loss would form part of a PI claim against the agent. Many years ago, I didn’t shut the gate on a cottage in the New Forest properly. The vendor got home to discover the ponies had eaten her much loved garden. 😬
