Of course agents are entitled to charge for their services, and of course requiring a deposit is reasonable. The big issue is that agents are charging prospective tenants, who have no opportunity for control of costs, and often with a no-refund clause, when the prospective tenant has no contract with the agents and the agent has no incentive to provide a fair and sound service to the prospective tenant. Yes, the tenant expects to pay costs eventually, but he is looking for a contract with the landlord and would be happy to pay expenses as part of that contract. The Agent is contracted to the Landlord, and the landlord should pay their costs. That's just fair practice.

Actually it might be just as useful to register GOOD tenants. There could then be no need for background checks etc, cutting costs for everyone.

Having been ripped off by several landlords as tenants we would always wish to meet a prospective landlord if possible, and would usually ask to approach one of his tenants. We have never gone to the expense of a credit check though. We have turned down rentals on the basis of what we have found - but we have also turned down otherwise suitable rentals offered with an agency because we could not have worked with the agent concerned. On the other hand we have made lasting friends of several landlords along the way. We would strongly recommend that any prospect tenant does the same; ones relationship with landlord or agent can make renting a happy or an ugly experience.

I've been both tenant and landlord several times and in several countries over the years, and I have to say the correspondents here are not recognising the lack of control over charges which gives rise to the tenants' discontent. We have a situation where agents compete for Landlords' business by jacking up fees for tenants, who have no say over the agent at all. In fact it's worse; the agent has an interest in refusing tenants after taking their 'non-refundable' fees and then just going out there and getting another tenant to rip off. I'm just coming back to England from Scotland where fees charge to tenants are illegal, and I am dismayed at how things have gone here while I've been away. Let us bring accountability back to where the decisions are - the Landlord. Yes; the fees are passed to the tenant, but the tenant has a contractual arrangement with the Landlord and expects to pay his expenses.
