The High Court has thrown out a request for a judicial review of the Government’s decision to cap Local Housing Allowance, the benefit paid to private tenants.

Charity Zacchaeus 2000 Trust argued that the Government acted outside the law in the way and had failed to comply with the Equality Act.

But Justice Underwood ruled the Government did have the power to introduce the changes to the way LHA payments are calculated, and was not in breach of the equality law.

While the judge criticised the Government’s equality impact assessment, he said there had been no ‘legal flaw’.

The case was over the Government’s decision to link LHA increases to the consumer price index. Previously, allowances had been set by local councils in line with average rents in the area.

CZK said it will appeal.
