New law gives tenants' association rights to more information

Some industry organisations have spotted that under new legislation now in effect, tenants’ associations are being given the right to gain contact information from their landlords or letting agents acting on a landlord’s behalf.

News On The Block, a website for flat owners, has identified that under Section 130 of the Housing and Planning Act 2016, the secretary of a tenants’ association will have the power to seek contact details of other leaseholders in a shared block, as long as they have agreed to having their details made available.

Amongst other regulations in the act, which came into effect last month, landlords or their representatives must make provision to provide tenants’ contact information within a specified period of time.

It is the responsibility of the landlords to seek consent from individual tenants to provide such information, and to set out how many tenants have not consented.

A court or tribunal will have the power to make an order should landlords fail to comply.
